What does the law say about late penalties?
The penalty rate must obligatorily appear on your quotes and invoices. In the absence of a mention, the ECB's key rate plus 10 points applies by default, from the first day of delay.
How to claim these amounts?
Penalties accrue automatically, without a formal notice being necessary. You just need to send your client a new invoice (or a debit note) including the precise calculation of the late interest to officially claim them.
